Terms of Service

  1. About these Terms

These Terms of Service (« Terms ») govern your access to and use of TheDiffuseur (the « Service »), a web application operated by LMVI Conseil (« LMVI Conseil », « we », « us », « our »).

By creating an account, connecting a third-party account, or using the Service, you agree to these Terms. If you do not agree, do not use the Service.

  1. Description of the Service

TheDiffuseur lets authorized users prepare, schedule and publish video content to social media accounts they own or are authorized to manage, including TikTok and YouTube.

The Service connects to these platforms only through their official APIs, and only after you have explicitly authorized it through the platform’s own consent screen. TheDiffuseur never asks for, and never stores, your TikTok or Google password.

  1. Eligibility and accounts

You must be at least 18 years old, or the age of legal majority in your country, and have the legal capacity to accept these Terms. If you use the Service on behalf of an organization, you confirm that you are authorized to bind that organization.

You are responsible for keeping your TheDiffuseur login credentials confidential and for all activity carried out under your account. Tell us promptly at jmh@lmvi.eu if you suspect any unauthorized use.

  1. Connecting third-party accounts

When you connect a TikTok or YouTube account, you authorize TheDiffuseur to perform only the actions covered by the permissions you granted, such as reading basic profile information and publishing the content you submit.

You can disconnect an account at any time:

  • in TheDiffuseur, by removing the connected account;
  • on TikTok, from your TikTok app settings (Security and permissions > Manage app permissions);
  • on Google/YouTube, at https://myaccount.google.com/permissions

Once an account is disconnected, the Service can no longer publish to it.

  1. Third-party platform terms

Your use of platform features through TheDiffuseur remains subject to each platform’s own terms and policies:

If these Terms conflict with a platform’s terms regarding your use of that platform, the platform’s terms prevail.

  1. Publishing content

Before any content is published, TheDiffuseur shows you:

  • the account it will be published to;
  • a preview of the content;
  • the publication settings.

Content is published only after your explicit confirmation.

For TikTok publications, you must choose the privacy level of each post; TheDiffuseur applies no default. You also choose whether comments, Duets and Stitches are allowed, where the account permits it.

If the content promotes a brand, product or service, including your own or a third party’s, you must disclose it using the commercial content settings provided.

TheDiffuseur does not add any watermark, logo or promotional element to your content.

Scheduled publications depend on the availability of the third-party platforms. A publication may be delayed, rejected or removed by the platform, and we cannot guarantee that it will be accepted or remain online.

  1. Your content and your responsibilities

You keep all rights to the content you submit. You grant LMVI Conseil a limited, non-exclusive, royalty-free license to host, process and transmit that content, solely to provide the Service to you: storing it until publication, and sending it to the platforms you selected.

You represent and warrant that:

  • you own, or have obtained all necessary rights, licenses and consents for, the content you publish, including music, images, trademarks and the likeness of any person appearing in it;
  • your content complies with applicable law and with the policies of the destination platform;
  • you publish only to accounts you own or are authorized to manage.

You must not use the Service to publish content that is unlawful, infringing, misleading, hateful, violent, sexually explicit, or harmful to minors. You must also not use it to send spam or automated mass postings that break platform rules, or to circumvent any platform’s limits, security measures or policies.

  1. Acceptable use of the Service

You agree not to:

  • access the Service by any means other than the interfaces we provide;
  • attempt to probe, disrupt or overload the Service;
  • reverse engineer the Service, except where the law expressly allows it;
  • resell or sublicense access to the Service without our written consent.
  1. Personal data

We process personal data in accordance with our Privacy Policy (https://lmvi-conseil.fr/privacy-policy/). It explains:

  • what data we collect from connected TikTok and YouTube accounts;
  • how we use, store and protect that data;
  • how long we keep it;
  • how you can exercise your rights under the GDPR.
  1. Availability and changes to the Service

We aim to keep the Service available but do not guarantee uninterrupted or error-free operation. We may modify, suspend or discontinue all or part of the Service, in particular when a third-party platform changes or withdraws its API. Where reasonably possible, we will give you prior notice.

  1. Suspension and termination

You may stop using the Service and request deletion of your account at any time by writing to jmh@lmvi.eu.

We may suspend or terminate your access if you breach these Terms or a platform’s policies, or if required by law or by a platform. When your account is closed, your connection tokens are revoked and deleted, and your stored data is deleted as described in the Privacy Policy.

  1. Intellectual property

The Service, including its software, design and trademarks, belongs to LMVI Conseil or its licensors. These Terms give you no rights to it other than the right to use the Service in accordance with them.

TikTok and YouTube are trademarks of their respective owners. TheDiffuseur is not affiliated with, endorsed by or sponsored by TikTok, ByteDance, Google or YouTube.

  1. Limitation of liability

To the extent permitted by applicable law, the Service is provided « as is ». LMVI Conseil is not liable for:

  • indirect damages, such as loss of audience, revenue, data or business opportunity;
  • actions, outages, rejections or removals decided by third-party platforms;
  • content published by users.

Nothing in these Terms limits liability that cannot be limited under applicable law, including your rights as a consumer where they apply.

  1. Changes to these Terms

We may update these Terms. The date at the top of this page shows the latest version. If a change is material, we will notify users through the Service or by email before it takes effect. If you continue to use the Service after that date, you accept the updated Terms.

  1. Governing law and disputes

These Terms are governed by French law. Before taking any legal action, please contact us at jmh@lmvi.eu so we can try to resolve the dispute amicably. If you are a consumer, you may also use a consumer mediation service free of charge.

Failing an amicable resolution, the courts of Nantes, France, have jurisdiction, subject to any mandatory rules protecting consumers.
